Booking & Rental Policy
1. BOOKING & PAYMENT TERMS
Deposit / Retainer
A non-refundable deposit of $125 is required at the time of booking to reserve the Event date.
The booking is not confirmed until the deposit has been received by 5Clicks Photobooth.
The deposit is applied toward the total contract amount.

Remaining Balance
The remaining balance is due on the Event date at the time of setup and prior to the commencement of services.
Services will not begin until payment is received in full.
Failure to remit the remaining balance at setup constitutes a material breach of this Agreement and may result in immediate cancellation of services, with the deposit forfeited and no refunds issued.
​2. ILLINOIS BIOMETRIC INFORMATION PRIVACY ACT (BIPA) COMPLIANCE
5Clicks Photobooth complies with the Illinois Biometric Information Privacy Act (740 ILCS 14).
By agreeing to this Agreement, Client acknowledges and agrees to the following:
Consent & Notice
Client represents that they have the authority to consent, and/or will provide notice to event attendees, that photographic images may be captured during the Event.
No Biometric Identification

Company does not intentionally collect, store, sell, or disclose biometric identifiers or biometric information, including facial geometry scans, fingerprints, or iris data.

Use of Images
Images captured by 5Clicks Photobooth are used solely to provide the agreed-upon photo booth services (digital sharing, printing, and delivery to event guests).
Client is responsible for informing event attendees about image capture and use, as required by applicable laws including the Illinois Biometric Information Privacy Act (BIPA).
By default, no images are used for marketing unless Client provides written or electronic consent prior to the Event.
Client may choose to grant 5Clicks Photobooth permission to use images for marketing, promotional, and portfolio purposes.
No compensation will be provided to the Client or event guests for the use of images for marketing or promotional purposes.
Indemnification (BIPA-Specific)
Client agrees to defend, indemnify, and hold harmless 5Clicks Photobooth from any claims, damages, penalties, or attorneys’ fees arising under BIPA that result from Client’s failure to inform guests or obtain any required permissions.
3. OPERATIONS, SPACE & POWER REQUIREMENTS Space Requirements
Client agrees to provide a safe, level setup area suitable for photo booth operations.
Setup Requirements
For a full-service photo booth experience (including backdrop, lighting, props, and/or printing), Client must provide a minimum setup area of 10' (L) x 10' (W) x 8.5' (H), free of obstructions and safe for equipment and guests.
For a digital-only setup (no backdrop, no printer, no props), Company may operate in a reduced footprint of approximately 5' x 5' or 6' x 6', subject to venue layout and Company approval.
If venue ceiling height is less than 8.5 feet, Client agrees to notify Company in advance so backdrop height or equipment configuration may be adjusted.
Client acknowledges that reduced space or ceiling height may limit available options or visual presentation and does not constitute grounds for refund or service extension.
Client is responsible for ensuring timely venue access, adequate space, and safe operating conditions.
Failure to meet setup requirements may result in reduced service time or inability to operate, with no refund.
Power Supply5Clicks Photobooth is a fully mobile service and may operate using venue-provided power or a
portable power source.
Client is responsible for communicating in advance whether standard electrical power will be available at the venue.
Client is responsible for ensuring that the venue provides access to a grounded 120V electrical outlet within 20 feet of the setup area, unless portable power is requested or required.
If venue power is unavailable, insufficient, or not communicated in advance, Company will utilize its portable power source, and a $50 portable power fee will automatically apply.
If Client requests use of the portable power station for any reason, the $50 fee applies regardless of venue power availability.
Company is not responsible for service interruptions caused by venue restrictions, power limitations, or lack of prior disclosure by Client.
Failure to provide accurate power supply information does not constitute grounds for refund or service extension.
Failure to meet power supply requirements may result in reduced service time or inability to operate, with no refund.
Outdoor Events
For outdoor events, Client must provide:
A dry, level surface.
Overhead shelter (tent or equivalent).
Company reserves the right to suspend or terminate services if conditions threaten the safety of equipment or personnel, with no refund.
4. DAMAGE TO EQUIPMENT
Client assumes full responsibility for any loss, theft, or damage to Company equipment caused by Client, guests, or venue staff, excluding normal wear and tear.
This includes, but is not limited to:

Equipment being knocked over

Liquid damage
-
Unauthorized handling
-
Theft
Client agrees to pay the full repair or replacement cost as determined by Company.
5. TRAVEL POLICY
Free Range: 35 Miles from Yorkville.
Travel Fee: $1.50 per mile (one-way) for locations beyond 35 miles.
Parking Fee: Client must provide free parking or reimburse the Company for parking costs in downtown Chicago or at venues without a lot.
6. CANCELLATION POLICY
The deposit is non-refundable under all circumstances.
Cancellations made more than thirty (30) days prior to the Event result in forfeiture of the deposit.
Cancellations made within thirty (30) days of the Event, including failure to remit the remaining balance at event setup, require payment of 100% of the total contract amount.
7. LIABILITY & INSURANCE
Indemnification: Client agrees to indemnify and hold 5Clicks Photobooth harmless from any claims or damages resulting from the event, except those caused by the Provider’s gross negligence.
COI: Provider maintains General Liability Insurance and can provide a Certificate of Insurance (COI) to the venue upon request (minimum 10 days' notice required).
8. LIMITATION OF LIABILITY
To the fullest extent permitted by Illinois law:
Company’s liability is limited to the amount paid under this Agreement.
Company is not liable for indirect, incidental, or consequential damages.
Company is not responsible for service failure due to Acts of God, power outages, venue interference, or third-party actions.
9. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Illinois.
Any legal action shall be brought in the courts of Kendall County, Illinois.
10. ELECTRONIC ACCEPTANCE & AGREEMENT
By checking the acceptance box on the Company’s website, Client acknowledges that they have read, understood, and agree to be bound by the 5Clicks Photobooth Booking Policy & Rental Agreement, including all terms, conditions, and addenda incorporated therein.
Client agrees that this electronic acceptance constitutes a legally binding signature in accordance with the Illinois Uniform Electronic Transactions Act (815 ILCS 333/) and that no handwritten signature is required for enforceability.
